Currently, drivers’ hours and other rules apply to work-related driving if the maximum weight of your vehicle or vehicle combination is more than 3.5 tonnes. These rules cover topics such as the maximum time a driver can drive for, required breaks, record keeping, vehicle maintenance, roadworthiness testing, and tachograph usage. Why This Matters

It’s estimated that 26% of the UK’s greenhouse gas emissions come from the transport sector, with vans accounting for 17% of those emissions.

The heavier battery packs in electric vehicles mean zero-emission vans can exceed the 3.5-tonne threshold, bringing them under stricter commercial vehicle regulations. This creates cost and compliance barriers for businesses considering electric vans.

Government Consultation: Key Proposals

Increased Weight Threshold

The government proposes raising the threshold at which zero-emission goods vehicles are subject to drivers’ hours and tachograph rules from 3,500 kg to 4,250 kg (including trailers, up to 7,000 kg MAM).

MOT Testing Simplification

Electric vans between 3,500 kg and 4,250 kg would shift from the HGV testing regime to the standard MOT system:

  • First test due three years after registration
  • Testing permitted at standard MOT centres (up to 3,500 kg), not HGV sites

Speed Limiter Review

While no formal change is proposed, the consultation invites feedback on removing speed limiter requirements for zero-emission vans.
