Have your say on proposed changes to UK chemical legislation

The Health and Safety Executive (HSE) has launched a public consultation on planned updates to the UK’s chemical safety framework. The proposed reforms affect biocides, chemical classification and labelling, and the export and import of hazardous substances.

The changes aim to reduce regulatory burdens while maintaining high safety standards in the post-Brexit landscape.

What changes are being proposed?

GB Biocidal Products Regulation (BPR)

  • Allow the UK to recognise approvals from other countries with similar safety standards
  • Move to a risk-based review system focused on high-risk biocides
  • Grant the government power to approve essential biocidal products in specific situations
  • Introduce flexibility for future amendments to the GB BPR system

Classification, Labelling and Packaging (CLP)

  • Streamline classification processes by reducing reliance on EU guidance
  • Remove the requirement to submit chemical classification notices to the HSE
  • Relocate classification guidance to the HSE website
  • Enable easier regulatory updates to CLP and supporting regulations

Prior Informed Consent (PIC) for Hazardous Chemicals

  • Remove restrictions on sending small amounts of hazardous chemicals for testing or research
  • Allow one-year waivers for exports of certain substances without prior approval from importing countries
  • Introduce powers for the government to make future changes to PIC regulations
