The Freight Containers (Safety Convention) Regulations (Northern Ireland) 2025 represent a significant update to the legal framework governing the use, approval, and maintenance of freight containers in Northern Ireland. These regulations replace the 1992 Regulations, bringing local standards in line with the International Convention for Safe Containers (CSC) 1972 and its latest amendments.
What is Covered?
The regulations apply to most freight containers used at work or supplied for use at work, including those used offshore and in a wide range of industrial activities. A “container” is defined as a robust, reusable transport unit (excluding vehicles and air transport-only equipment) designed for easy handling and intermodal transport, with specific size requirements.
Approval and Marking
All containers must have valid approval, either for their design type or as individual units. Approval can be issued by the Health and Safety Executive for Northern Ireland (the Executive), an appointed organisation, or a competent authority from a country that has ratified the Convention. Each container must display a durable, non-corroding safety approval plate, permanently fixed in a visible location. This plate must show essential information such as the approval reference, date of manufacture, identification number, maximum operating gross mass, stacking and racking limits, and examination details.
Maintenance and Examination
Containers must be kept in efficient working order and good repair. They must be examined regularly under an approved scheme or continuous examination programme. Examination details must be clearly marked on or near the safety approval plate. If responsibility for maintenance and examination is transferred by contract (such as a lease or bailment), the new responsible party must ensure compliance.
Transitional Arrangements
Containers constructed before 1 July 2014 may retain their original safety approval plates, provided no structural modifications have been made.
